These Terms of Service ("Terms") govern your access to and use of iconmma.com and any related landing pages or funnels operated by ICON MMA ("ICON MMA," "we," "us," or "our") (collectively, the "Site"). By accessing or using the Site, submitting a form, or requesting a free class, you agree to these Terms. If you do not agree, do not use the Site.

These Terms govern your use of the Site only. They do not govern your visit to our physical location, participation in classes, or the separate liability waiver and release you will be asked to sign in person before participating in any class. That physical waiver is a separate document with its own terms.

2. Use of the Site

The Site provides information about ICON MMA's programs and allows you to request a free class or otherwise contact us. You agree to use the Site only for lawful purposes and to provide accurate information when you submit a form, including your name and contact information, and, if applicable, your child's name and age.

You agree not to:

Submit false or misleading information through the Site

Use the Site to submit another person's information without their knowledge or, in the case of a minor, without being that minor's parent or legal guardian

Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems

Use the Site for any purpose other than inquiring about or requesting our services

3. Eligibility

You must be at least 18 years old to submit a form on the Site on your own behalf. If you are submitting a request for a free class on behalf of a child, you represent that you are that child's parent or legal guardian and have the authority to provide their information and to bring them to a class. Our free class offer requires the child to be at least 5 years old and able to follow instructions and maintain focus for the duration of the class.

4. Free Class Offer

No payment card is required to request a free class through the Site. A release waiver must be signed in person on arrival before participating in any class; that waiver is a separate document not governed by these Terms. Submitting a request through the Site does not guarantee a reserved spot in any specific class time; we will follow up by text message and phone call to confirm.

5. Text Message and Phone Communications

By submitting your phone number through the Site, you consent to receive text messages and phone calls from ICON MMA related to your class request, including confirmation and scheduling follow-up. Message and data rates may apply, and message frequency varies. Reply STOP to any text message to opt out at any time, or contact us using the information in Section 1. Consent to receive texts or calls is not a condition of receiving any class or service that does not require it.

6. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is owned by or licensed to ICON MMA and is protected by applicable intellectual property laws. You may not copy, reproduce, or use Site content for any commercial purpose without our prior written permission.

7. Third-Party Services

The Site may use or link to third-party services, including our scheduling and CRM platform (GoHighLevel) and advertising platforms (such as Meta), to operate the funnel and process your request. We are not responsible for the practices or content of third-party services; your use of those services is subject to their own terms.

8. Disclaimers

The Site and all information on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure.

Nothing on the Site constitutes a guarantee of results from participating in our classes or programs.

9. Limitation of Liability

To the fullest extent permitted by law, ICON MMA and its owners, coaches, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed one hundred dollars ($100).

This section does not limit or waive any rights or claims related to injury occurring during in-person classes, which are governed by the separate liability waiver signed on arrival, not by these Terms.

10. Indemnification

You agree to indemnify and hold ICON MMA harmless from any claims, damages, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

11. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Subject to Section 12 below, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in San Bernardino County, California.

12. Dispute Resolution: Binding Arbitration and Class Action Waiver

Agreement to Arbitrate. You and ICON MMA agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court.

Class Action Waiver. You and ICON MMA agree that any arbitration or claim will be conducted only on an individual basis and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against ICON MMA.

Arbitration Procedure. Arbitration will be conducted by a mutually agreed-upon arbitrator or arbitration organization, in San Bernardino County, California, or another mutually agreed location, in accordance with its rules then in effect. Judgment on the arbitration award may be entered in any court having jurisdiction.

Exceptions. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement or unauthorized access to the Site.

This arbitration provision applies only to disputes arising from the Site and these Terms. It does not apply to, and does not limit, any claim related to physical injury occurring during a class, which is addressed separately in the physical liability waiver you sign on arrival.

13. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" at the top of this page reflects the latest revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
